Terms of Service

Version 1.6 · Effective from 10 August 2026

These Terms of Service (the "Terms") govern your access to and use of the services provided or operated by:

  • FitQ Studio OÜ
  • Geneto OÜ

(together, "we"), including but not limited to:

  • the FitQ web platform (fitq.me), FitQ mobile applications and FitQ TV applications (Android TV, Samsung Smart TV)
  • the Geneto Lifestyle web application (geneto.com) and mobile applications
  • the Gymwolf web platform (gymwolf.com) and mobile applications
  • the SparQ web and mobile applications
  • other web and mobile applications offered under the FitQ, Geneto, Gymwolf and SparQ brands

By using our services, you confirm that you have read and agreed to these Terms. If you do not agree to the Terms, please do not use the services.

1. Description of the Services

Our services may include the following:

  • personalised training plans and instructional materials
  • nutrition recommendations, a nutrition diary and nutrition tracking
  • a workout diary and workout logging (including gym workouts in Gymwolf and generated or guided workouts in SparQ)
  • genetic testing and personalised feedback based on it (Geneto)
  • progress tracking and statistics
  • consultations with trainers and specialists
  • community features, challenges and social elements
  • content related to health, wellbeing and lifestyle
  • with your permission, synchronisation of data with external health platforms (e.g. Health Connect, Apple Health, Google Fit, Strava)

The exact scope of the services may change over time and may differ between applications and platforms.

2. Account Creation and Responsibility

2.1 Registration

A user account is required to use the services. You undertake to provide true, accurate and up-to-date information and to keep it up to date where necessary.

2.2 Shared User Account

A shared user account may be used across the FitQ, Geneto, Gymwolf and SparQ services. The account enables cross-service use in accordance with the Privacy Policy.

2.3 Account Security

You are responsible for keeping your account and login credentials confidential. Notify us immediately if you suspect unauthorised use of your account.

2.4 Age Restriction

The services may be used by persons who are at least 16 years old. For users under 18, we assume the consent of a parent or guardian.

3. Use of the Services

3.1 Permitted Use

You may use the services only for lawful purposes and in accordance with these Terms.

3.2 Prohibited Activities

When using the services, the following are prohibited:

  • violating laws or the rights of third parties
  • providing false, misleading or malicious information
  • distributing malware, viruses or other harmful technologies
  • disrupting or damaging the operation of the services, or attempting to circumvent them
  • using automated systems without permission
  • harassing or disturbing other users
  • infringing intellectual property rights

4. Subscriptions and Payments

4.1 Prices

Prices for the services are stated in euros and include VAT unless stated otherwise. We reserve the right to change prices, giving reasonable advance notice.

4.2 Payment

We accept various payment methods, including bank links, card payments, mobile payments (via Zlick), in-app purchases (Google Play, App Store) and partner solutions (e.g. Stebby). Payments are processed by certified payment service providers.

4.3 Automatic Renewal

Recurring subscriptions may renew automatically until cancelled by the user. Subscriptions can be managed in the account settings or in the subscription management of the relevant app store (Google Play, App Store).

4.4 Right of Withdrawal

A 14-day right of withdrawal applies to digital services, except where use of the service has already begun, in accordance with the law.

5. Intellectual Property

5.1 Our Content

All materials related to the services (including texts, videos, programmes, design and software) belong to FitQ Studio OÜ, Geneto OÜ or their licensors.

5.2 Licence to Use

We grant you a limited, non-exclusive and non-transferable right to use the services for personal, non-commercial purposes.

5.3 User-Generated Content

You retain the rights to the content you create, but you grant us a licence to use it for providing and developing the services.

6. Health and Medical Disclaimer

IMPORTANT:

Our services do not replace medical advice, diagnosis or treatment. Workouts, nutrition recommendations, feedback based on genetic information and other health- or wellbeing-related content are general and informational in nature.

Recommendations provided through the services are based on general assumptions about an ordinary or average user. They do not automatically take into account all of your illnesses, injuries, medications, pregnancy, physical limitations or other individual circumstances. Even when a service adapts content based on information you provide or on genetic information, this does not constitute an individual medical assessment.

We do not guarantee that any particular workout, nutrition plan, programme or other recommendation is suitable for your health condition, abilities or needs. You are responsible for taking account of your health and how you feel, choosing an appropriate level of exertion, and adapting or reassessing a plan where necessary.

If you have a health condition, injury, chronic illness, are pregnant or are unsure whether a recommendation is suitable for you, consult a doctor or other qualified healthcare professional before starting or continuing a programme. Stop the activity and seek professional medical assistance where appropriate if you experience pain, dizziness, unusual shortness of breath or any other concerning symptom.

You use the services at your own risk. Nothing in this section excludes or limits our liability to the extent that such exclusion or limitation is not permitted by applicable law.

7. Genetic Testing (Geneto)

7.1 Ordering a Test

Genetic testing is an optional additional service that you can order through the Geneto service. To take the test, you send us a sample according to the instructions of the test kit.

7.2 Sample Processing

The sample is analysed by our genetic testing partner laboratory, which receives only a pseudonymised sample and code (not your name or contact details). The processing of genetic data is described in more detail in our Privacy Policy.

7.3 Results

The test results and the feedback based on them are informational in nature and do not constitute a medical diagnosis or treatment recommendation. Consult a healthcare professional before making health decisions based on the results.

7.4 Right of Withdrawal

As the genetic test is a personalised service based on your individual needs, the right of withdrawal ends, to the extent permitted by law, once the sample has been submitted to the laboratory for analysis. Before the sample is submitted, the standard 14-day right of withdrawal applies.

7.5 Withdrawal of Consent

You may withdraw your consent to the processing of genetic data at any time — in that case your genetic data will be deleted and no further recommendations based on genetic information will be calculated (see the Privacy Policy).

8. Limitation of Liability

To the maximum extent permitted by law:

  • we are not liable for indirect or unforeseeable damages
  • our total liability is limited to the amount you have paid us during the last 12 months
  • the services are provided on an "as is" and "as available" basis
  • we do not guarantee uninterrupted or error-free operation of the services

9. Indemnification

You agree to compensate us for all damages and costs arising from your breach of the Terms or misuse of the services.

10. Changes to and Termination of the Services

10.1 Changes to the Services

We may change, suspend or discontinue the services or parts of them. Where possible, we will give advance notice of material changes.

10.2 Account Termination

You may close your account at any time. We have the right to suspend or terminate an account in the event of a breach of the Terms or failure to meet payment obligations.

11. Privacy

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

12. Dispute Resolution

We aim to resolve disputes through negotiation. If no agreement is reached, disputes will be resolved in the courts of the Republic of Estonia.

Consumers also have the right to turn to the Estonian Consumer Disputes Committee.

13. Governing Law

These Terms are governed by the laws of the Republic of Estonia.

14. Changes to the Terms

We may update these Terms from time to time. Continued use of the services after changes take effect constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms proves to be invalid, this does not affect the validity of the remaining provisions.

Governing language: These Terms are drawn up in English. Translations into other languages are provided for convenience only; in the event of any discrepancy or dispute, the English-language version prevails.
