A shared user account may be used across the FitQ, FunTastyQ Fit, Gymwolf and SparQ services. The account enables cross-service use in accordance with the Privacy Policy.

You are responsible for keeping your account and login credentials confidential. Notify us immediately if you suspect unauthorised use of your account.

2.4 Age Restriction

The services may be used by persons who are at least 16 years old. For users under 18, we assume the consent of a parent or guardian.

When using the services, the following are prohibited:

• violating laws or the rights of third parties
• providing false, misleading or malicious information

4.4 Right of Withdrawal

A 14-day right of withdrawal applies to digital services, except where use of the service has already begun, in accordance with the law.

5. Intellectual Property

5.1 Our Content

All materials related to the services (including texts, videos, programmes, design and software) belong to FitQ Studio OÜ, Geneto OÜ or their licensors.

5.2 Licence to Use

We grant you a limited, non-exclusive and non-transferable right to use the services for personal, non-commercial purposes.

5.3 User-Generated Content

You retain the rights to the content you create, but you grant us a licence to use it for providing and developing the services.

5.4 Truly Anonymous Statistics for Scientific Research

By accepting these Terms, you agree that we may use truly anonymous, aggregated statistics from our services for scientific research and share those statistics with universities and other research institutions for that purpose, subject to section 2.10 of the Privacy Policy. The information must not identify you or anyone else, directly or indirectly, including by combination with other information reasonably available to us or the recipient.

This agreement does not cover personal data, individual health or genetic records, pseudonymised user records or any dataset that can be linked back to a person. It does not grant a new right to process personal data or health data for research before anonymisation, replace separate consent where required, or include genetic-test-derived data, health-platform imports or family members' data. We require active, recorded acceptance of the version that contains this clause. Acceptance of an older version, continued use of an app or a device permission does not count as agreement to this new clause.

Research institutions must use the anonymous information only for the stated scientific purpose, must not attempt to identify anyone and must not pass it on outside those conditions. Once information is genuinely and irreversibly anonymous, it cannot be located or removed for a specific user. Your rights concerning the original personal data remain unchanged.

6. Health and Medical Disclaimer

IMPORTANT:

Our services do not replace medical advice, diagnosis or treatment. Workouts, nutrition recommendations, feedback based on genetic information and other health- or wellbeing-related content are general and informational in nature.

Recommendations provided through the services are based on general assumptions about an ordinary or average user. They do not automatically take into account all of your illnesses, injuries, medications, pregnancy, physical limitations or other individual circumstances. Even when a service adapts content based on information you provide or on genetic information, this does not constitute an individual medical assessment.

We do not guarantee that any particular workout, nutrition plan, programme or other recommendation is suitable for your health condition, abilities or needs. You are responsible for taking account of your health and how you feel, choosing an appropriate level of exertion, and adapting or reassessing a plan where necessary.

If you have a health condition, injury, chronic illness, are pregnant or are unsure whether a recommendation is suitable for you, consult a doctor or other qualified healthcare professional before starting or continuing a programme. Stop the activity and seek professional medical assistance where appropriate if you experience pain, dizziness, unusual shortness of breath or any other concerning symptom.

You use the services at your own risk. Nothing in this section excludes or limits our liability to the extent that such exclusion or limitation is not permitted by applicable law.

GPS distance, route, timing and pace information is approximate and can be affected by the device, signal quality, permissions and interruptions. These features are intended for recording workouts, and should not be relied on for emergency assistance or safety-critical navigation.

AI-assisted estimates and feedback, including food identification, portion sizes, calories and macronutrients estimated from a photo, can be incomplete or incorrect. Review and correct an estimate before relying on it or saving it to your diary. These features do not provide a medical assessment or replace the professional advice described above. Nothing in this paragraph limits your mandatory rights as a consumer.

7. Genetic Testing (FunTastyQ Fit)

7.1 Ordering a Test

Genetic testing is an optional additional service that you can order through the FunTastyQ Fit service. To take the test, you send us a sample according to the instructions of the test kit.

7.2 Sample Processing

The sample is analysed by our genetic testing partner laboratory, which receives only a pseudonymised sample and code (not your name or contact details). The processing of genetic data is described in more detail in our Privacy Policy.

7.3 Results

The test results and the feedback based on them are informational in nature and do not constitute a medical diagnosis or treatment recommendation. Consult a healthcare professional before making health decisions based on the results.

7.4 Right of Withdrawal

As the genetic test is a personalised service based on your individual needs, the right of withdrawal ends, to the extent permitted by law, once the sample has been submitted to the laboratory for analysis. Before the sample is submitted, the standard 14-day right of withdrawal applies.

7.5 Withdrawal of Consent

You may withdraw your consent to the processing of genetic data at any time — in that case your genetic data will be deleted and no further recommendations based on genetic information will be calculated (see the Privacy Policy).

8. Limitation of Liability

To the maximum extent permitted by law:

• we are not liable for indirect or unforeseeable damages
• our total liability is limited to the amount you have paid us during the last 12 months
• the services are provided on an "as is" and "as available" basis
• we do not guarantee uninterrupted or error-free operation of the services

9. Indemnification

You agree to compensate us for all damages and costs arising from your breach of the Terms or misuse of the services.

10. Changes to and Termination of the Services

10.1 Changes to the Services

We may change, suspend or discontinue the services or parts of them. Where possible, we will give advance notice of material changes.

10.2 Account Termination

You may close your account at any time. We have the right to suspend or terminate an account in the event of a breach of the Terms or failure to meet payment obligations.

11. Privacy

The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms.

12. Dispute Resolution

We aim to resolve disputes through negotiation. If no agreement is reached, disputes will be resolved in the courts of the Republic of Estonia.

Consumers also have the right to turn to the Estonian Consumer Disputes Committee.

13. Governing Law

These Terms are governed by the laws of the Republic of Estonia.

14. Changes to the Terms

We may update these Terms from time to time. Continued use of the services after changes take effect constitutes acceptance of the updated Terms, except where active acceptance is required. In particular, the anonymous-research permission in section 5.4 requires active, recorded acceptance of the version that contains it; continued use or a device permission does not grant that permission.

15. Severability

If any provision of these Terms proves to be invalid, this does not affect the validity of the remaining provisions.
